{"id":11,"date":"2024-12-11T01:40:05","date_gmt":"2024-12-11T01:40:05","guid":{"rendered":"https:\/\/lib.purdue.edu\/uco3\/?page_id=11"},"modified":"2025-11-18T16:25:09","modified_gmt":"2025-11-18T16:25:09","slug":"infringement","status":"publish","type":"page","link":"https:\/\/lib.purdue.edu\/uco\/infringement\/","title":{"rendered":"Infringement"},"content":{"rendered":"\n<div class=\"wp-block-cover\"><img decoding=\"async\" class=\"wp-block-cover__image-background wp-image-679\" alt=\"\" src=\"https:\/\/infostudies.purdue.edu\/wp-content\/uploads\/2024\/01\/03.jpg\" data-object-fit=\"cover\" \/><span aria-hidden=\"true\" class=\"wp-block-cover__background has-background-dim\"><\/span><div class=\"wp-block-cover__inner-container is-layout-constrained wp-block-cover-is-layout-constrained\">\n<p class=\"has-text-align-center wp-block-paragraph\" style=\"font-size:66px;font-style:normal;font-weight:700\">Copyright Infringement Penalties<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity is-style-dots\" \/>\n\n\n\n<p class=\"has-text-align-center wp-block-paragraph\" style=\"font-size:22px\">Copyright infringement is the act of violating any of a copyright owner\u2019s exclusive rights granted by the federal Copyright Act.<\/p>\n<\/div><\/div>\n\n\n<div  class=\"section \">\n    <div class=\"container\">\n                \n\n<div class=\"wp-block-columns page-layout-columns columns is-multiline is-layout-flex wp-container-core-columns-is-layout-8f761849 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column column is-full-tablet page-layout-main is-layout-flow wp-block-column-is-layout-flow\">\n<h1 class=\"wp-block-heading\">Key Elements and Penalties<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">There are three elements that must be in place in order for the infringement to occur.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u200bThe copyright holder must have a valid copyright.<\/li>\n\n\n\n<li>\u200bThe person who is allegedly infringing must have access to the copyrighted work.<\/li>\n\n\n\n<li>\u200bThe duplication of the copyrighted work must be outside the exceptions.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The legal penalties for copyright infringement are<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u200bInfringer pays the actual dollar amount of damages and profits.<\/li>\n\n\n\n<li>\u200bThe law provides a range from $200 to $150,000 for each work infringed.<\/li>\n\n\n\n<li>\u200bInfringer pays for all attorneys fees and court costs.<\/li>\n\n\n\n<li>\u200bThe Court can issue an injunction to stop the infringing acts.<\/li>\n\n\n\n<li>\u200bThe Court can impound the illegal works.<\/li>\n\n\n\n<li>\u200bThe infringer can go to jail.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Plagarism<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Copyright infringement and plagiarism are two different issues. Copyright is a federal law that protects original works from being copied and distributed without the author\u2019s permission unless one of the exceptions applies. Plagiarism is passing off someone else\u2019s work as one\u2019s own or lack of attribution. There is no federal or state plagiarism law but there can certainly be severe repercussions for plagiarizing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Copyright infringement example: Incorporating an entire poem by Maya Angelou into a published work without her permission. The poem is property attributed to Ms. Angelou.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Plagiarism example: Using a line or even an entire poem by Maya Angelou in a paper and not attributing the poem to the author or citing the source.
